:( Nevada Supreme Court stays indigent defense order
The Nevada Supreme Court has issued an order concernind ADKT 411, which addresses representation of indigent defendants in criminal and juvenile delinquency cases. The Court orders the following:
The Indigent Defense Commission shall reconvene.
The membership in the Indigent Defense Commission shall be expanded to include two representatives from the Nevada District Attorneys Association.
The implementation date for performance standards is delayed from 4/1/08 to 7/15/08.
The performance standards are referred beack to the Indigent Defense Commission for review and revision and report to the Court by 6/30/08.
Weighted caseload studies by Washoe and Clark Counties will be due 1/1/09 instead of 7/15/08.
The rural counties will not be required to submit an administrative plan regarding appointment of counsel, approval of fees and the determination of indigency is stayed for all counties other than Clark and Washoe until further order of the court.
The Rural Issues Subcommittee will have new members, who are identified in the order, and will meet concerning rural issues.
The Court will hold a public meeting on 7/1/08 at 2pm and will hear from committee members and others on 9/5/08.
