Nevada Supreme Court issues 2 opinions

The Nevada Supreme Court issued two opinions today.

In Cote H. v. District Court, the Court declines to intervene by way of extraordinary relief after concluding that NRS 201.230(1), which defines the offense of lewdness with a minor under the age of 14, can be used to adjudicate as delinquent a minor under the age of 14. "We conclude that because NRS 201.230's plan, broad language applies to "persons" of all ages, the statute can be used to adjudicate as delinquent minors under the age of 14, even though they are partof the class of persons protected by the statute."

In Dancer v. Golden Coin, Ltd., the Court concludes that the Federal Fair Labor Standards Act does not preempt the Nevada Wage and Hour Law and finds that a class action is appropriate for the case, which concerns whether the Glitter Gulch is obligated to pay dancers minimum wage.
