No opinions today

Another sad Thursday for the blog devoted to discussion of Nevada Supreme Court opinions. The next date scheduled for release of opinions is Thursday, October 4th.

The Court has published 38 opinions this year. At the current rate of 4.2 opinions per month, we should end the year with 51 opinions. I believe that there were 121 opinions in 2006, 90 opinions in 2005, 105 opinions in 2004, and 69 opinions in 2003.

As I mentioned in a prior post, this is simply unacceptable. It is no small wonder that the state of the law in a lot of major areas of criminal and civil law, is simply lacking. The other day I did a Nevada case law search and typed the words "Fourth Amendment." Can you believe, I came up with a piddling 100 cases? With all the exceptions to the warrant requirement and so many diverse issues regarding the Fourth Amendment, that is all the case law they have? ONly 100 or so cases? That is pathetic. Even a sparsely populated state like Alaska...has more opinions regarding the Fourth Amendment.

If the Nevada Supreme Court does not want to publish a lot of cases...that is their perogative. However, the court should allow practicing attorneys (and the public) to have access to unpublished opinions, like many other courts do. I can name a number of states that has a databank with non-published opinions--Alaska, Texas, California, Tennessee, etc.

51 published opinions in one year...is simply not enough. I'm hoping that Nevada will soon have a Court of Appeals. Maybe then, Nevada will have a lot more published opinions.
